Quirk and Bakalor, P.C. successfully defended a products liability action against a ladder manufacturer in federal court.
The plaintiff had fallen off a ladder, sustaining numerous severe and permanent injuries, alleging that the ladder was defective. Notwithstanding that the ladder had actually been manufactured out of specification, defendant successfully argued that the ladder was still reasonably safe and in no way defective.
No offer was made by defendant. The jury came back with a defense verdict.
